Can I move my kids out of state

If you’re in the process of separating from your partner, you will more than likely face the task of making many difficult decisions. You’ll probably be thinking about dividing up assets, but more importantly - you’ll be wondering about custody and your living situation.

Oftentimes, after a separation, one or both partners will move closer to their parents or other family members. And sometimes, that means moving out of state. But, it’s important to ask - CAN I move my kids out of state? Is it okay for them to be away from their mother/father?

In Pennsylvania, this decision is ALWAYS made based on the best interest of the child or children. It is required that you send a “Notice of Intent to Relocate” to the other parent and state your relocation plans as well as your proposed new custody agreement. An affidavit can be filed within 30 days if the other parent disagrees with the terms that you have proposed.
